US to Restrict Red Bull Gray Market Entry

The importation of unauthorised Red Bull energy drink products into the US will be prohibited, the US International Trade Commission has said.

Unauthorised energy drink products include those that infringe on any marks or designs confusingly similar to Red Bull’s or are otherwise misleading as to source, origin or sponsorship.

The commission’s rule, which will ensure the product through an authorised distribution channel, will also allow the US Customs Department to block gray market Red Bull products from US ports.

Earlier, Red Bull received a $2.1m settlement from a gray marketer and recently filed numerous lawsuits seeking damages from gray market importers.
